Auction Terms and Conditions

- To register, the following must be provided: ID, proof of address (no less than 3 months old), valid tax number and full FICA documentation.
- If bidding on behalf of a company, trust or another person: CK1/CM1 documents, company resolution, letter of authority and proof of authorisation to bid.
- A registration fee of R5 000 to R10 000 (subject to property size and specifications) is payable for online bidding (an invoice will be issued upon registration). This fee is fully refundable if you are not the successful bidder. No registration fee applies to on-site auctions.
- Go Property Solutions is acknowledged as the effective cause of the introduction to the property.
- All auctions are subject to a reserve price and confirmation by the seller within 3 (three) working days.
- The auction will commence on the day of the auction and will not be delayed for any reason.
- A 10% bidder’s premium plus VAT (if applicable) is payable on the fall of the hammer.
- A deposit of 5% is payable within 3 (three) working days upon signing the Sales Agreement. Should your bid be unsuccessful or declined, all monies paid will be refunded in full.
- Properties are sold “voetstoots”, “as is” and with no duty to repair. Go Property Solutions, its auctioneer and representatives shall not be liable for any inaccuracies, errors, hidden or latent defects or undisclosed information.
- If you sign the Sales Agreement in a representative capacity, you waive the legal exceptions of excussion and division and bind yourself as surety and co-principal debtor in solidum with the party you represent.
- All auctions comply with Section 45 of the Consumer Protection Act 68 of 2008 and its regulations.
- The auctioneer (as representative of Go Property Solutions) may bid on behalf of the owner and has sole discretion to regulate bidding increments.
- Any reason for the sale other than normal disposition will be announced by the auctioneer on the day of the auction.
- The bidder’s record and vendor roll will be available for inspection during normal office hours at the offices of Go Property Solutions.
- All monies will be held in a trust account in terms of the Estate Agency Affairs Act and paid to the conveyancers (less the bidder’s premium) upon seller acceptance.
- Transfer of the property will only occur once valid tax certificates for both seller and buyer are provided.
- Your details will be added to the Go Property Solutions database for notification of future auctions and industry news.
- Any amendments to these rules will be announced verbally by the auctioneer on the day of the auction.
- Should the listed auctioneer be unavailable, the conducting auctioneer is deemed to have certified these rules and is personally liable for their content.
- These rules need not be read out at the auction if they were made available at least 24 hours prior.
- At the auction, any person present may raise objections to these rules, which will be recorded on the vendor roll.
- These rules do NOT exclude liability for inaccurate information provided in auction advertising, non-compliance with the Consumer Protection Act regulations or rules regarding inspection of the property or documentation.
- By completing registration and participating, you confirm acceptance of all the above.
